1. About These Terms

These Terms of Service govern your use of FreeBy44, a personal financial independence tracking website operated by Shrutika Sujit Patil, a sole proprietor doing business as "Dreamverna", based in Pune, Maharashtra, India. By signing in with Google and using FreeBy44, you agree to these Terms. If you do not agree, please do not use the website.

Your use of FreeBy44 is also governed by our Privacy Policy, which forms part of these Terms.

2. Eligibility

You must be at least 18 years old to use FreeBy44. By using the website you represent and warrant that you are 18 or older. FreeBy44 is not intended for or directed at children, and we do not knowingly collect personal data from anyone under 18. If we become aware that a minor has provided personal data, we will delete it promptly.

3. What FreeBy44 Does

FreeBy44 is a personal tracking tool that helps you:

• Track your FIRE corpus against committed milestones
• Log monthly income, investments, and expenses manually
• Monitor asset values, outstanding liabilities, and insurance policies
• View projected corpus growth based on your own inputs and assumptions
• Manage sinking funds for planned future expenses

FreeBy44 is not a financial advisory service, investment platform, or regulated financial product. Think of it as a smart, persistent spreadsheet — it remembers your data month after month so you can spot drift early.

5. Your Account and Responsibilities

6. Acceptable Use

You agree not to:

• Store data belonging to other individuals without their consent
• Attempt to reverse-engineer, scrape, or extract data from the website
• Use the website in any manner that violates applicable Indian laws
• Attempt to circumvent authentication or access other users' data
• Use the website to provide financial advice to third parties for consideration

Violations of this section may result in immediate suspension or termination of your account.

7. Third-Party Services

FreeBy44 relies on these services to operate:

• Google OAuth (NextAuth.js) — authentication. Governed also by Google's own Terms and Privacy Policy.
• MongoDB Atlas — cloud database storage for your financial data.
• Vercel — hosting and serving the website.
• Vercel Analytics — privacy-friendly, cookieless usage analytics (page views and session counts). No cookies are set. No financial data is collected. IP addresses are processed transiently to derive a daily hash for deduplication and are not retained in identifiable form.

Dreamverna is not responsible for the terms, policies, or availability of these services.

8. Your Data

You own the financial data you enter into FreeBy44. Dreamverna does not claim ownership over your personal financial information. We use your data solely to provide the website's features — we do not sell it, share it with advertisers, or use it beyond operating the service. You can request deletion at any time (see Section 10).

9. Intellectual Property

The FreeBy44 website — including its code, design, branding, and algorithms — is the intellectual property of Dreamverna. You may not copy, redistribute, or create derivative works without written permission.

10. Account Termination and Data Deletion

You may stop using FreeBy44 at any time. You can permanently delete your account and all associated data directly from Settings → Delete my account, or by emailing us at contact@dreamverna.com. Deletion is completed in our primary systems immediately upon your request. Encrypted backups may retain residual data for up to a further 30 days before being overwritten in our normal backup rotation, after which all copies are permanently removed. For details of inactivity-based deletion and our retention practices, see our Privacy Policy. Dreamverna reserves the right to suspend access if you violate these Terms.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Dreamverna and its proprietor from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your wilful misconduct or negligence in your use of FreeBy44, your breach of these Terms, your violation of any applicable law or regulation, or any data you enter into the website.

12. Limitation of Liability

FreeBy44 is provided "as is" without warranties of any kind. To the maximum extent permitted by applicable law, Dreamverna's aggregate liability arising out of or relating to your use of FreeBy44 shall not exceed the greater of ₹5,000 (five thousand rupees) or the total fees paid by you to Dreamverna in the twelve months preceding the claim.

Dreamverna shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, savings, data, or business opportunity, even if advised of the possibility of such damages.

Nothing in these Terms limits liability for gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable Indian law.

13. Service Modifications and Changes to These Terms

Dreamverna reserves the right to add, modify, or discontinue any feature of FreeBy44 with reasonable notice where practicable.

We may also update these Terms from time to time. When we do, we will update the version and date above. For significant changes, we will notify you via the email linked to your Google account or via an on-site notice. Continued use after changes take effect constitutes acceptance of the updated Terms, except for changes that materially affect how we process your personal data — for those, continued use does not constitute consent. We will provide advance notice of any such changes and seek renewed explicit consent before they take effect.

14. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Digital Personal Data Protection Act, 2023, the details of the Grievance Officer are:

We acknowledge complaints within 24 hours and endeavour to resolve them within 15 days of receipt. If your complaint is not resolved to your satisfaction, you may escalate it to the Data Protection Board of India once it becomes operational under the DPDP Act, 2023.

15. Governing Law

These Terms are governed by the laws of India. Before commencing legal proceedings, you agree to first exhaust the Grievance Officer process set out in Section 14. If the matter remains unresolved, any disputes shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
